How do I change employer on an Employee Card?

It depends on which card you hold. With a standard (dual) Employee Card you notify the Ministry at least 30 days before the change and wait for its written confirmation before starting. With free access to the labour market you may start immediately and report within 3 working days after. Blue Cards follow their own rule. The notification itself is free.

Who this is for: Employee Card holders moving to a new employer or position while the card is valid, and employers planning the start date.

Not for: People whose job has already ended: your first deadline is the 90-day rule in the lost-job answer, and the exceptions below may work in your favour.

Employee Card — deadline to report a change of employer (standard card)

Notify at least 30 days before the change, and wait for written Notification of Compliance

You, if you hold a standard (dual) Employee Card issued under § 42g(2) — the ordinary case. It does NOT bind you if your nationality gives you free access to the Czech labour market, if you hold a separate work permit, or if you hold a Blue Card: all three of those report AFTER the change instead of notifying before it.

Employee Card — deadline to report a change of employer (free labour-market access)

May start immediately, but must report within 3 working days after starting

You, if your nationality gives you free access to the Czech labour market under § 98 of the Employment Act (Act 435/2004), or if you hold a separate work permit. If you hold an ordinary Employee Card and neither of those is true, this is not your rule: you have to notify 30 days BEFORE the change instead, not report it afterwards.

Blue Card — deadline to report a change of employer or work position

Within 3 working days of the change, after which you may change employer

EU Blue Card holders ONLY. The Employee Card rule is different: a standard Employee Card holder must notify 30 days BEFORE the change and wait for approval. A Blue Card holder may change first and report after, provided the § 42i(1) conditions still hold.

The six-month wait at the start of a card

Employee Card — how soon after getting the card you may change employer at all

At the earliest 6 months from the day the decision issuing your Employee Card became final

Holders of a standard (dual) Employee Card. Separately from the notice period, there is a waiting time before you are allowed to change employer at all — and it does not apply if your employment ended because your employer dismissed you on one of the organisational or health grounds in § 52(a) to (e) of the Labour Code, by agreement on those same grounds, by immediate termination under § 56, or in your probationary period. You have to PROVE that reason at the same time as you notify.

The floor has exceptions written for people whose job collapsed under them: it does not apply where the previous employment ended by employer dismissal on the grounds of § 52(a) to (e) of the Labour Code, by agreement for those same reasons, by immediate cancellation under § 56, or during the probationary period. Expect to prove the ground with the notification, the way the employment ended is not taken on trust.

Step by step, for the standard card

  1. 1Agree the new job and confirm the position can be held by an Employee Card holder, see which jobs qualify.
  2. 2File the change notification with the Ministry no later than 30 days before the planned change, using the official form. An incomplete notification counts as never filed, so check every attachment.
  3. 3Wait for the written Notification of Compliance (sdělení o splnění podmínek). Do not start the new job before it arrives.
  4. 4Start, and keep the confirmation with your residence papers.

Quick questions

Is there a fee for reporting the change?
No. Reporting a change of employer, work position or an additional position is free. Replacing the physical card for other reasons is a separate, paid act.
Can I start work the day I send the notification?
On a standard card, no: you may start only after the Ministry’s written Notification of Compliance. With free access to the labour market, yes, and you report within 3 working days after starting.
My job already ended. Do the 30 days still apply?
Your governing deadline becomes the 90-day rule, and the report of new employment must reach the Ministry within it. See the lost-job answer.
Does changing employer renew my card’s validity?
No. The card keeps its own expiry date regardless of the change; extensions are a separate application with their own window, see fikce pobytu and filing windows.
