My Czech application was refused. What can I still do?

Act in days, not weeks: the standard appeal (odvolání) deadline is 15 days from the day the decision was notified to you. Before writing anything, read the stated reasons and use your right to inspect the file: refusals are specific, and the cure depends entirely on which condition the authority says you missed.

Who this is for: Applicants holding a written refusal of a Czech visa, residence permit, extension or similar decision, and people whose refusal just arrived in the datová schránka.

Not for: Applications that are merely slow: that is inaction, not refusal, and has its own remedy, see decision deadlines.

The clock: 15 days from notification

Deadline to appeal a refused application

15 days from notification of the decision

Appeals under the Administrative Procedure Code, which is what governs immigration decisions unless the Aliens Act sets a different period for that specific decision. The clock runs from when the decision is NOTIFIED to you, not from the date printed on it. If the decision failed to tell you how to appeal, or told you wrongly, you get 15 days from the corrected notice and in any case no more than 90 days from notification.

Notification is not when you read the letter; a decision can count as delivered even if you never opened it, which is one more reason the address rules matter, see reporting changes. Find the notification date first, then count.

The file shows what the authority actually relied on: which document it found missing, which register it queried, what a workplace inspection reported. An appeal that answers the real ground beats a general plea every time. Inspection is in person; the file access form covers the request.

Shape of a useful appeal

  1. 1Identify the exact legal ground cited in the refusal, it is written in the decision’s reasoning.
  2. 2Match it with evidence that was missing or misread: a document the file lacked, proof the condition was in fact met at the time.
  3. 3File the appeal with the authority that decided, within the 15 days, keeping proof of filing. The decision names where the appeal goes.
  4. 4If the refusal stands and you believe the procedure itself failed, court review exists, with its own short deadlines; that step usually deserves a lawyer.

Refused and considering simply applying again instead? Sometimes that is faster, but an unaddressed refusal ground refuses the second application too. Fix the ground either way.

Quick questions

Does my stay stay legal while the appeal runs?
It depends on what was refused and your position when you filed; the protective fiction covers properly filed extension applications through a FINAL decision, which includes a timely appeal, see fikce pobytu. Verify your own case before relying on it.
The refusal says I can’t appeal. Can that be right?
Some visa refusals have a different remedy, a request for a new assessment, instead of the standard appeal. The decision itself states which remedy applies and the deadline; follow the words of your decision, not a general page.
Should I pay someone to appeal for me?
For a document that was genuinely missing, you can often cure it yourself. For disputed grounds, inspections, or anything heading toward court, experienced help earns its fee. Beware anyone promising outcomes.
