I married a Czech citizen. What residence do I get?

Marriage gives no automatic residence, but it gives the strong route: the Act treats family of a Czech citizen with registered permanent residence like family of an EU citizen. You apply for the residence card (pobytová karta), with a short attachment list, a small fee, no labour-market test, and a considerably faster road to permanent residence than the general 5 years.

Who this is for: Third-country spouses of Czech citizens living in Czechia, and couples planning the move. The same logic covers the other § 15a family relationships: a parent caring for a citizen under 21, dependent children and parents.

Not for: Spouses of Czech citizens living ABROAD with no Czech residence to join, and family of third-country residents, whose route is the general one in the family reunification guide.

Why the EU rules apply to a Czech marriage

Family of a Czech citizen — treated as family of an EU citizen

The EU family-member rules apply, including the residence card route

A third-country national who is, to a Czech citizen registered for permanent residence in Czechia, a spouse, a parent caring for a citizen under 21, or a dependent descendant or ascendant as § 15a(1)(a) to (d) defines them. The Act extends the EU family-member provisions to them, so the route is the residence card (pobytová karta), not the general family-reunification permit.

“§ 15a odst. 2: "Rodinným příslušníkem občana Evropské unie se dále rozumí cizinec, který je ke státnímu občanu České republiky přihlášenému k trvalému pobytu na území ve vztahu uvedeném v odstavci 1 písm. a) až d)."”

This single provision is why a spouse of a Czech citizen bypasses the general family-reunification permit, with its sponsor-residence and income conditions, and files under the gentler EU-family regime instead, see the family residence card for the card itself.

What you file, and what it costs

EU citizen's family member — how long the residence card lasts and when to extend it

Issued for the expected length of the EU citizen’s stay, at most 5 years; extendable by the same period, repeatedly; apply before the current card expires

Non-EU family members of an EU citizen who hold a pobytová karta. The card lasts as long as the EU citizen you live with is expected to stay, up to 5 years, and it can be extended by the same length again as many times as you need. You must apply BEFORE your current card runs out — unlike the Employee Card there is no published earliest date, so there is no window to wait for.

“§ 87o odst. 2: "(2) Pobytová karta se vydává na dobu shodnou s předpokládanou dobou pobytu občana Evropské unie, nejvýše však na 5 let. Platnost pobytové karty lze o stejnou dobu prodloužit, a to i opakovaně. O prodloužení platnosti pobytové karty je rodinný příslušník občana Evropské unie povinen požádat před skončením platnosti této karty."”

  1. 1Marriage document in order first: a foreign marriage certificate needs legalisation and certified translation, see documents from abroad.
  2. 2File the residence-card application at the Ministry office for your address, the form page walks the fields.
  3. 3Attach the short list: travel document, the proof of the relationship, proof of accommodation, health insurance where required.

The relationship must be real and stay real: marriages of convenience are investigated, and a card obtained through one collapses with consequences. Expect questions designed to test an actual shared life; a genuine couple has nothing to script.

The road ahead: permanent residence and citizenship

Family of Czech citizens reach permanent residence on a much shorter clock than the general 5 years; the exact door depends on your facts, and the permanent residence guide maps the family paths. Citizenship later also bends for spouses: the required years soften, while the B1 Czech exam and the other conditions stay, see the citizenship guide.

Quick questions

Can I work while the card application is pending?
Family members of Czech citizens fall under the free-access logic once their position is documented; the clean sequence is to file promptly and keep proof of filing. For job changes after that, the free-access reporting rule applies, see changing employer.
We married abroad. Does Czechia recognise it?
A valid foreign marriage is recognised through the usual document channel: legalisation appropriate to the country plus certified Czech translation, and registration in the Czech special registry (zvláštní matrika) is the clean long-term move for the record.
What if my spouse is Czech but we live in Germany?
Then Czech residence law is not yet in play; EU free-movement rules in your country of residence are. The route on this page starts when the Czech spouse is registered for permanent residence in Czechia.
